Returns, Refunds and Customer Terms
1. Application
These terms apply to all sales made by Buffalo Machines Limited (“the Company”). Customers are classified as either:

Private Consumers (individuals purchasing outside the course of business), or
-
Business Customers (any individual or entity purchasing in the course of business, trade, or profession).
Different rights and obligations apply depending on this classification.
A. PRIVATE CONSUMERS
2. Consumer Returns (14-Day Cooling-Off Period)
Private Consumers are entitled to cancel their order within 14 days of delivery in accordance with the Consumer Contracts Regulations 2013.
Refunds will be issued to the original payment method and may take up to 15 working days to appear once goods are received.
3. Condition of Returned Goods
Items must be returned:

In a resalable condition
-
With original packaging (where reasonably possible)
Deductions may be made for any loss in value due to handling beyond what is necessary.
The following handling charges apply:
- Returned parts: 30% handling charge
- Returned machines: 15% handling charge
4. Faulty or Misdescribed Goods
If goods are faulty, not as described, or not fit for purpose, Private Consumers have rights under the Consumer Rights Act 2015.
Customers should notify the Company as soon as possible at sales@buffalomachines.co.uk.
5. Delivery Inspection
Consumers should inspect goods upon delivery. Any visible damage should be reported as soon as reasonably possible.
6. Return Costs (Consumers)

If returning unwanted goods, the customer is responsible for return postage

If goods are faulty or incorrect, the Company will cover reasonable return costs
B. BUSINESS CUSTOMERS
7. Basis of Sale
For Business Customers, these terms constitute the entire agreement and override any conflicting terms unless agreed in writing.
The provisions of the Consumer Contracts Regulations 2013 and other consumer legislation do not apply.
8. Returns Policy (B2B)
Returns are accepted strictly at the Company’s discretion within 14 days of delivery.
This policy does not create any contractual right and may be withdrawn or amended without notice.
9. Inspection and Acceptance
Business Customers must:

Inspect goods immediately upon delivery

Notify the Company of any damage, shortage, or defect within 48 hours
Failure to do so constitutes acceptance of the goods and a waiver of any right to reject.
10. Faulty Goods (B2B)
All defects must be reported within 48 hours of delivery.
The Company reserves the right to inspect goods before agreeing any remedy.
Any remedy shall be limited, at the Company’s sole discretion, to:

Repair
-
Replacement
-
Refund
11. Condition of Returns (B2B)
Returned goods must be:

Unused
-
In original packaging
-
In fully resalable condition
-
Deductions may be made for any loss in value due to handling beyond what is necessary.
The following handling charges apply:
- Returned parts: 30% handling charge
- Returned machines: 15% handling charge
The Company may:

Refuse non-compliant returns
-
Apply restocking or handling fees
-
Reduce refunds to reflect diminished value
Used, fitted, or modified goods are non-returnable unless defective at delivery.
12. Exclusion of Implied Terms
To the fullest extent permitted by law, all implied terms, including those under the Sale of Goods Act 1979, are excluded.
Where exclusion is not permitted, liability is limited to the minimum allowed by law.
13. Limitation of Liability
Nothing limits liability for:

Death or personal injury caused by negligence

Fraud or fraudulent misrepresentation
Subject to this, total liability is limited to the price paid.
The Company shall not be liable for:

Loss of profit
-
Loss of business
-
Indirect or consequential losses
14. Returns Risk and Costs
All returns are at the customer’s risk and expense unless agreed otherwise.
The customer remains responsible for goods until received by the Company.
15. Change of Mind (B2B)
Returns due to change of mind:

Require prior written approval
-
Are subject to restocking fees
-
Are not guaranteed
16. Collections
For goods collected in person:
-
Risk transfers immediately upon collection
-
All return costs remain the customer’s responsibility
C. GENERAL TERMS (ALL CUSTOMERS)
17. Refund Processing
Approved refunds will be processed to the original payment method and may take up to 15 working days.
18. Entire Agreement
These terms constitute the entire agreement between the parties.
19. Governing Law
These terms are governed by the laws of England and Wales, and disputes shall be subject to the exclusive jurisdiction of its courts.
